1. Welcome
1.1 These Terms of Use (Terms) govern your access to and use of our website available at www.stellarprogram.com.au (Website) and our services, which may include the Program, our newsletters, events, podcasts and other media content, our communities and any other service, content or engagement we offer, whether through the Website, in person or on a third-party platform (Services).
1.2 In these Terms, we, our or us means Gandel Invest Pty Ltd ACN 160 466 624, trading as Stellar Program (Stellar), the owner and operator of the Website, and you or your means any person who accesses or uses the Website or our Services, or otherwise engages with us.
1.3 By accessing or using the Website, registering for or attending an event, subscribing to a newsletter, using our other Services or otherwise engaging with us, you agree to be bound by these Terms and our privacy policy available at www.stellarprogram.com.au/privacy-policy (Privacy Policy), each as amended from time to time. If you do not agree with these Terms, you must stop using the Website and our Services immediately.
1.4 Please read these Terms carefully and contact us if you have any questions.
2. Our Services
2.1 These Terms apply to all your dealings with us, including your use of the Website and our Services. Additional terms may apply to some Services (for example, event registration terms or the terms of a third-party platform we use). If they conflict with these Terms, they prevail for that Service.
2.2 Stellar runs a growth program to support startups (Startups) and their founders (Founders) together with a community of mentors, service providers and other partners who support it (Partners), as described on the Website (Program).
3. Applying to participate in the Program
3.1 A Startup may apply to participate in the Program by submitting an application (Application) through the Website, in the form Stellar publishes from time to time.
3.2 Submitting an Application does not guarantee acceptance into the Program. Acceptance is at Stellar’s sole discretion and is subject to Stellar’s due diligence and any other conditions Stellar notifies to the applicant, including the Startup entering into a separate written agreement with Stellar (Program Participation Agreement).
3.3 You must ensure that any information you provide in or with an Application is true, accurate and not misleading, and must promptly update Stellar if that information changes.
3.4 Stellar may reject an Application, or withdraw an offer to participate in the Program, at any time and without providing reasons.
3.5 If you are accepted into the Program, you will be asked to enter into a Program Participation Agreement, which will supersede these Terms for your time in the Program.
4. Program Alumni community
4.1 Founders who complete the Program may become part of Stellar’s alumni community (Program Alumni).
4.2 Stellar may provide members of the Program Alumni with continued access to the Program Alumni Slack community, specific Program Alumni events, check-ins and support that Stellar makes available from time to time, provided they continue to follow the code of conduct available at www.stellarprogram.com.au/code-of-conduct (Code of Conduct) and any terms that apply to the relevant community or event. Stellar may change or discontinue Program Alumni benefits on reasonable notice.
5. Newsletters, events and media
5.1 If you subscribe to our newsletters or other communications, you consent to us sending them to you. You can unsubscribe at any time using the link in the message or by contacting us. We handle your personal information in accordance with our Privacy Policy.
5.2 If you register for or attend an event, you must follow the Code of Conduct, any event rules and the directions of our team. Any additional terms that apply to a ticketed event, including refunds, will be set out when you register.
5.3 We may photograph and record events (including by livestream) and use the material to promote Stellar, the Program and our Services. If you do not want to be photographed or recorded, tell a member of our team and we will take reasonable steps to respect that.
5.4 Our podcasts, articles, videos and other media content are provided for general information only. If you appear in or contribute to our media content (for example, as a guest or speaker), we will agree the terms with you separately.

6.3 Stellar may amend the Code of Conduct at any time by publishing an updated version on the Website. A breach of the Code of Conduct may result in Stellar suspending or terminating your access to the Program, an event or a community under these Terms, without limiting Stellar’s rights under a separate agreement with you.
